In Florida, as in many states, one of the areas of law that people are not familiar with or don’t realize there may be a right to make a claim is what’s called negligent security.
If you or a family member or a loved one for example is in an apartment and are robbed there you’re injured or it happens in a mall or other commercial location and you’re injured in that type of incident where there’s a robbery or other crime you have a right to make a claim against the property owner’s insurance for a negligent security claim.
In Florida unfortunately there are areas with large levels of crime, high levels of crime and in Florida a landlord or property owner actually has a affirmative obligation, a duty to provide a level of security commensurate with the crime that has occurred at that location in the surrounding neighborhood.
So if heaven forbid you or a family member or friend is a victim of a crime or killed in a crime you must consult with a lawyer who has experience in that area to see what level of crime has occurred in the surrounding area.

And so a property owner, a property manager has an affirmative duty to be sure that the place that you visit or the place that you rent is safe and must do all reasonable things to make sure it’s safe weather it includes security guards if it’s a large apartment complex or a mall.
