Hi. I’m Brent Probinsky with the law firm of Probinsky & Cole. Many persons ask us, “If we’re going to make a claim for them in an accident case, will the case go to trial?” Do they have to go to trial in front of a judge and jury?
Depending on the severity of – the level of injury in the case, we might file a lawsuit or we might not. We try to settle cases before filing a lawsuit if it’s possible.
Many times, we’re not able to settle for a just amount unless we file a lawsuit. We go through a process where there are depositions, discovery in those cases. Ninety-nine percent of them resolve before the case actually goes to trial.
So the answer is occasionally we go to trial to obtain justice when it’s necessary, if we don’t a get a just settlement, a fair settlement. Most cases settle before we file a lawsuit. The rest of them often settle during the litigation process before trial.
So every case is a little bit different. We do whatever is necessary to obtain a fair settlement for you.
We’re here to help you. There’s no fee for consultation. Please call us. We’re happy to explain your case and what we think we can do to help you. Thank you.
