A lot of persons ask us, “How do I prove a case of negligent security and what is a case of negligent security?”

Essentially when you or a family member are attacked and injured in a robbery, in an altercation that takes place at your house or in a commercial setting, it could be an apartment building, it could be a commercial center, shopping center. If you are seriously injured, you have a right to make a claim for negligent security against the owner or management of the premises.

In Florida, a premises owner, a landlord is required – has an affirmative duty to provide security to protect the persons that are legally on the property, whether it be the tenants, their friends, their family or others.

They have a duty to provide that level of security, which is commensurate with the level of crime that is expected at that location. It could be the area, the level of crime in the neighborhood. It could be other incidents at the location.

Unfortunately in Florida, in other locations throughout the United States, there are a series of criminal attacks particularly against persons in their homes. Often there are robberies and so on and we have clients that are severely injured. We have clients whose family members were killed.
