How To Immigrate Legally Into The United States

Today I’m going to talk to you about general immigration, how to immigrate legally into United States. You have several ways to come legally in the United States and stay legally. So family petition, employment, internship, student visa and investment.
Family, pretty easy. If you have any American family, they can sponsor you for your Green Card legal residency. And how long does it take? Depends on who’s sponsoring you. If it’s your American spouse, within a year, you’re going to get your Green Card. However if it’s an American sibling, look at 15 years.
The other way to come and stay legally in United States is employment. You cannot apply for your own work visa. It’s always an American employer called a sponsor who’s going to request a work permit for you. What kind of work permit? It depends on your college education and your professional experience.
In the United States we have the H-1B visa. You need at least a bachelor’s degree. We have the L visa which is transfer of manager or the O visa for extraordinary ability people. How
long does it take? It depends on the type of visa and of course of your college education and work experience but we’re looking at a few weeks to a few months.
With those visas, usually your spouse can work except for the O visa and your minor children under 21 can come with you.
The other option is internship. It’s called a J-1 visa. Same thing. It’s an American employer who will sponsor you for the J-1 visa.
It’s very temporary. It’s used for seasonal work but also sometimes for teachers, 3 years for teachers but more like 6 months to 18 months for other employment. Your spouse can come with you but cannot work and your minor children can come with you.
Student visa. It’s called an F-1 visa. You’re registered, accepted, admitted in a college in the United States and that college will give you what we call an I-20. That I-20, you make a request for a student visa at the American embassy in your country and your proof for the duration of your studies.
Let’s say you come for a bachelor’s degree. Your visa is valid for four years. Your spouse can come and cannot work. Your minor children can come with you.
Finally we have the investor visa. That’s the favorite. You can come with your family if you invest at least $100,000 in personal fund into a business in the United States and create employments.
If that’s the case, you are entitled to an E-2 visa. It’s usually valid from two to five years, depending on your country of origin. Your spouse can work and your minor children under 21 can come into the United States and study.
