Hi. Brent Probinsky with the law firm of Probinsky & Cole. Many persons ask, “How long do I have to make a claim for my accident?” Well, it depends what it is.
In a death case, there’s a two-year statute limitation, which is the period of time that you have to file a lawsuit or make a claim. After the two years period of time, you’re barred.
In a medical malpractice case, it’s also two years. In a case of negligence, where it’s an auto accident or this other type of negligence of defective product, it’s a four-year limit or statute of limitations.
In a case under a contract such as you sue your insurance company or you sue someone under a contract, it’s a five-year statute of limitation. So the different statutes that apply, there are exceptions to that. There are ways to extend them under certain circumstances. But you must be aware that there are limits of the period of time in which you have a right to make a claim or to file a lawsuit.
