A lot of folks ask, “Well, do I have to go to court?” People like that big gray building, the judge, the jury, all the security guards. They don’t want to be there. And we at Probinsky & Cole understand that.
In personal injury cases, most cases do not go to trial. Depending on the case that comes into the office, how serious is the injuries? Is it a broken leg? Or, was somebody unfortunately killed? Well, how big is the insurance from the person that caused the accident? That will determine whether we file a lawsuit or not, or try to get the case resolved without a lawsuit. But without a lawsuit the case can be resolved in six months to a year, sometimes a bit longer.
If we file a lawsuit, where there are very serious injuries or death and there’s a very large insurance policy of the person that caused that accident, that’s what a lawsuit is required. Because you’re not going to be paid by an insurance company until you go to the whole process of taking depositions, sworn statements, engineers that we hire who evaluate what happened. And then the insurance company knows all the details from our perspective, they also know it from their perspective. They’ve hired their own engineers and experts. And they can clearly evaluate the case and say, “All right, if we go to trial we’re probably going to lose, we’re probably going to win, it’s a 50-50 based on liability, on witnesses.” So, that gets us to the point where there’s an opportunity for a fair resolution, it’s called a mediation, a meeting before trial.
Of the cases we filed lawsuits on, 95% resolved before going to trial, before going in front of a jury and judge. About 5% of the cases we file go to trial in front of a jury or judge. We help our clients through that process. They sit with us in the trial. We explain. We prepare them for their testimony and experts. And to get a just result, sometimes it’s necessary to have a jury of your peers and the community listen to you, listens to the case, listen to doctors, listen to family members, listen engineers and make a fair decision.
