Today I’m going to talk to you about the investor visa. That’s a way for foreigners to come to the United States, invest capital in an American company, create employment and obtain a temporary visa to live and stay in the United States.
How does it work? You have two things that you have to do to obtain, to qualify for an E-2 visa. It’s invest at least $100,000 in a business in the United States and create employment.
What does it mean to invest money in a business? It means you create a brand new business yourself or you buy an existing business or you buy a franchise in the United States and you create employments.
The philosophy behind E-2 visa for United States was to bring value and employment to the United States. So you have to open employment to American potential employees or legal resident in the United States.
The two questions we always get for the E-2 visa is whether we have to invest before or after getting your E-2 visa. The risk is on you. You have to invest before, knowing if you’re going to get your E-2 visa.
To qualify and be able to apply for an E-2 visa, we need to prove that you invested the money. So your business is up and running when we apply for an investor visa.
The second question I always get is, “Can I apply in the United States or do I have to go back home at the American embassy to get my visa?” You have to go back home. An E-2 visa is always at the American Embassy level that your request is being processed and approved or not.
So you will always have to go back home to get your visa. If it’s approved, within four, five days, you get your visa and you can come to the United States and live and work here. Your spouse gets a general work permit, so he or she can work legally for whoever he or she wants and your minor children can live with you here and go to school in college.
