What Happens If You Are Partially At Fault in a Case?

Hi. My name is Zachary Cole with Probinsky, Cole & Usquelis. I’m going to talk briefly about what happens if you are partially at fault in a case. Florida is one of the states where it’s OK to bring a claim and you still may have a case if you’re partially at fault. It’s called a comparative fault state.
Now if you would take a case fully through trial, what would happen is the jury or a judge will decide the proportion that you are at fault or any other parties if there are multiple parties involved and say you’re 10 percent at fault. They would just reduce the amount of your damages by 10 percent. So this can happen in a variety of ways.
Say you’re not wearing your seatbelt. That’s one way. Say you’re following a little bit too closely but somebody slams on their brakes in front of you. That’s another way or perhaps you pull in front of somebody and then they rear-end you.
These do not kill your case. They just may reduce the value somewhat of your case but we still have all of the arguments that are available to us in a normal case and we will focus on the negligence of the other parties involved.
